General Terms and Conditions

1. Introductory provisions, details of the Service Provider

These General Terms and Conditions (hereinafter: GTC) contain the conditions for using the online sales service operated by Renáta Bordás, sole trader (hereinafter: Service Provider) on the bravetorave.hu website (hereinafter: Webshop).
The details of the Service Provider can be found in the Imprint of the Webshop (name, registered address, registration number, tax number, contact details). E-mail address for contact: hello@bravetorave.hu.
The Webshop sells clothing products transformed through upcycling (recycling), as well as second-hand clothing items. Due to the nature of the products, they are typically unique, limited-quantity pieces; their condition and any signs of previous use are indicated in the product description.
These GTC become part of the contract between the parties with the text in force at the time the order is placed. By placing an order, the Buyer accepts the provisions of these GTC.
The language of the contract is Hungarian (or English on the English-language interface of the Webshop). The concluded contract does not qualify as a written contract; it is not filed by the Service Provider and is not accessible afterwards.
These GTC are governed by Hungarian law, in particular the following legislation:

Act V of 2013 on the Civil Code (Civil Code);
Act CVIII of 2001 on certain issues of electronic commerce services (Ekertv.);
Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses;
Act CLV of 1997 on consumer protection;
NGM Decree 19/2014 (IV. 29.) on the procedural rules for handling warranty and guarantee claims relating to goods sold under contracts between consumers and businesses.
2. Range of products available for purchase
The products listed in the Webshop can be ordered online. The information provided about the products (description, size, material composition, condition, photos) is for informational purposes only; second-hand and upcycled products may have unique characteristics arising from manual alteration and prior use, as indicated in the product description, which do not constitute defects.

The prices shown are in Hungarian Forints and include value added tax, unless the Service Provider is exempt from VAT on a subjective basis – in which case the prices do not include VAT. The prices do not include shipping costs, which are indicated separately before the order is finalised.

As the products are typically unique items, a given product is generally available in one copy only; if it sells out in the meantime, the Service Provider will notify the Buyer accordingly.
3. Order process
The Buyer places the selected product(s) in the shopping cart, provides billing and shipping details, selects the shipping and payment method, and then finalises the order after review.

By clicking the "[label of the order finalisation button, e.g. 'Place Order']" button, the Buyer places an order entailing a payment obligation. Data entry errors can be corrected before the order is submitted.

The Service Provider confirms receipt of the order electronically, without delay, but no later than within 48 hours. The contract is concluded upon receipt of the confirmation. If the confirmation does not arrive within 48 hours, the Buyer is released from the binding offer.
4. Payment terms
Available payment methods:

The ordered products remain the property of the Service Provider until the purchase price (and, where applicable, the shipping fee) has been paid in full.
5. Shipping and delivery
Shipping methods and fees:

Unless otherwise agreed, the Service Provider hands over the order to the carrier within [e.g. 3–5 business days]. Upon receipt of the product, the Buyer is obliged to check the integrity of the package; in case of damage, they may request that a report be drawn up in the presence of the carrier.
6. Right of withdrawal (14-day withdrawal right of the consumer)
This section applies to Buyers who qualify as consumers (i.e. natural persons acting outside the scope of their profession, independent occupation or business activity).
Under Government Decree 45/2014 (II. 26.), the consumer may withdraw from the contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the day on which the consumer or a third party other than the carrier and indicated by the consumer takes physical possession of the product.
The right of withdrawal may be exercised:

by sending an unambiguous statement to [Service Provider contact, e-mail: hello@bravetorave.hu], or
by using the model withdrawal form provided for by law (see the annex to these GTC).

The consumer may also exercise the right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the product.
Effects of withdrawal:

the consumer must return or hand over the product to the Service Provider without undue delay, but no later than 14 days from the date of communicating the withdrawal;
the direct cost of returning the product shall be borne by the consumer;
the Service Provider shall reimburse the total amount paid by the consumer as consideration, including delivery costs (except for the additional costs arising from the consumer's choice of a type of delivery other than the least expensive standard delivery offered), no later than 14 days from the date on which the Service Provider is informed of the withdrawal. The reimbursement shall be made using the same means of payment as the consumer used for the initial transaction;
the Service Provider may withhold the reimbursement until it has received the product back, or until the consumer has supplied evidence of having sent back the product (whichever is the earlier);
the consumer shall be liable for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.

The right of withdrawal cannot be exercised in the cases specified in, among others, Section 29 of Government Decree 45/2014 (II. 26.), including in particular:

in the case of a product which has been made to the consumer's specifications or clearly personalised, i.e. altered specifically for the consumer according to their individual requirements (custom-made or custom-fitted item);
in the case of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery, if the consumer has already opened the packaging.
7. Warranty of conformity, product liability
Warranty of conformity. In the event of defective performance by the Service Provider, the Buyer may enforce a warranty of conformity claim in accordance with the rules of the Civil Code: they may request repair or replacement, or – subject to the statutory conditions – a price reduction or withdrawal. In the case of a consumer, it shall be presumed that a defect which becomes apparent within one year of performance already existed at the time of performance.

Product liability. In the event of a defective product, a Buyer who qualifies as a consumer may also enforce a product liability claim against the manufacturer (or distributor) in accordance with the Civil Code. A product liability claim may be enforced within two years of the product being placed on the market.

Guarantee (warranty). No mandatory guarantee is required by law for the present product category (second-hand and upcycled clothing). The Service Provider does not provide a voluntary guarantee unless expressly stated for a particular product.
7. Security and Data Protection
The Data Controller applies appropriate technical and organisational measures to ensure the secure processing of personal data, and takes all reasonable steps to prevent unauthorised access, modification, loss or misuse.
8. Complaints handling and legal remedies
The Buyer may submit a complaint regarding the product or the Service Provider's activities to the e-mail address hello@bravetorave.hu. The Service Provider will investigate the complaint and – in the case of a written complaint – respond substantively in writing within 30 days.
If the consumer disagrees with the handling of the complaint, or if an investigation was not possible, they may turn to the following forums:

Consumer protection authority: the competent district office (contact: fogyasztovedelem.kormany.hu).
Conciliation board: the conciliation board competent for the consumer's place of residence or habitual residence. The board competent for the Service Provider's registered address is the [Pest County Conciliation Board]. The Service Provider is subject to a cooperation obligation in conciliation board proceedings.
Court: the consumer is also entitled to initiate civil litigation.
9. Miscellaneous provisions
The Service Provider is entitled to unilaterally amend these GTC; the amendment takes effect upon publication in the Webshop and applies to orders placed after the date of entry into force. Orders already placed are governed by the GTC in force at the time the order was placed.
If any provision of the GTC proves to be invalid, this shall not affect the validity of the remaining provisions.
The processing of personal data is governed by the Privacy Policy of the Webshop.
